We will attempt to resolve the dispute informally within 30 days of receiving your notice. Jury Trial Waiver

Class Action Waiver

To the fullest extent permitted by law, you and Exam Practice Hub each agree that any dispute will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class action, collective action, consolidated action, or representative proceeding. The court may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

If a court decides that applicable law prevents enforcement of any part of this Class Action Waiver as to a particular claim or request for relief, then that claim or request must be brought separately in the courts identified above, and all other claims will continue in individual proceedings as required by this Section.

Time Limit on Claims

Any claim arising out of or relating to these Terms or your use of Exam Practice Hub must be filed within one (1) year after the claim arose. Claims filed after this period are permanently barred, except where applicable law prohibits a shortened limitations period, in which case the shortest period permitted by law applies.

Severability

If any part of this Section is held to be unenforceable, the remaining parts will continue in full force and effect. If the Class Action Waiver is held unenforceable as to any claim, that claim will be severed and brought in court as required above, and all other claims will continue under the remaining provisions of this Section.
